Meeting Summary:

Chairman Husta called the meeting to order at 7:04PM and read the Agenda into the record.

Chairman Husta stated Alternate Member Kathie Grambling would be acting for Brian Taylor on all cases tonight.

Old Business: -Stephen Granfield re: Appeal requesting an Area Variance on Stone Dock Rd.

-Hopped Up Café re: SUP for a Limited Service eating and drinking establishment at 2303 Lucas Ave

New Business: None

Chairman Husta opened the Public Hearings with the Pledge of Allegiance.

 

Appeal of CEO’s determination of classification of additional Business Uses as a Restaurant and Drinking Establishment by Hopped Up Café at 2303 Lucas Avenue in the B-2 zoning district at tax map number 70.9-2-22.

Motions

Mark Knudsen motioned to continue public hearing for documents input until the August 27, 2014 ZBA meeting; Dan Proctor seconded the motion which was then called to a vote:

  • Mark Knudsen-Aye
  • Kathie Grambling (Alternate)-Aye
  • Dan Proctor-Aye
  • Paris Perry-Aye

The motion was thereupon adopted by a vote of five ayes; zero nays with no abstentions and one member absent

Old Business:

Special Use Permit by Hopped Up Café to operate a Limited Service Eating and Drinking Establishment at 2303 Lucas Tpke.

Update: In order for the Application to be considered complete, Applicants need to submit a completed short EAF and the fee. Applicants stated they had started the EAF, but had questions. They reviewed their questions with the Board and submitted the EAF at the meeting. They stated they would bring a fee by next week. The Secretary e3xplained the free is held until it is definite that the application is moving forward, but it must be submitted for the application to be complete

No official actions were taken.

Attorney Larry Wolinsky left the meeting at 7:30PM

Appeal of CEO requesting an Area Variance from Granfield, Stephen at 165 Stone Dock Rd. in R-1 zoning at tax map number 69.4-2-11.

Motions:

Mark Knudsen motioned to classify the action as Type II under SEQRA; Dan Proctor seconded the motion which was then called to a vote:

Paris Perry motioned to schedule the public hearing for the August 23, 2014 ZBA meeting; Dan Proctor seconded the motion which was then called to a vote:

  • Kathie Grambling (Alternate)-Aye
  • Dan Proctor-Aye

The motion was thereupon adopted by a vote of five ayes; zero nays with no abstentions and one member absent

                                                               Public Hearing

Area Variance application by Terwilliger, James, A, Property Owner and Deevy, Dawn of 0.39 acres to allow the conversion of an existing single family residence into a two family residence with an overnight in-home dog sitting business in one of the units and a SUP for the uses. Property is located at 10 Old US Hwy 209 at tax map number 69.2-2-8.

Kathie Grambling motioned to continue public hearing until August 27, 2014 ZBA meeting; Mark Knudsen seconded the motion which was then called to a vote:

Mark Knudsen motioned to adjourn the meeting; Paris Perry seconded. The motion was called to a vote, which was as follows:
