Zoning Board of Appeals Minutes 02-25-04
MEETING MINUTES
FEBRUARY 25, 2004

The regular monthly meeting was held at Town Hall at 7 p.m.

Present: Will Husta, Chairman, M. Knudsen, P. Perry, H. Safier

The meeting began with the pledge to the flag.
Public Hearing
1.  Shultis            60.4-2-38             Acres 1.14      Zone dist. A3
                      19 White Pines Road
                      Accord, NY 12404
Area Variance
Mr. & Mrs. Shultis are here to represent the file.  The applicant wishes to build a shed and needs to ask for a 10ft variance because the proposed site does not comply with zoning requirements.  The applicant reviewed his area variance criteria.
-The Maps and file were reviewed by the Board.
-H, Safier asks where is the back lot access.  Shultis replied on Bone Hollow Road.
-H. Safier asks where is the Nelson home?  Shultis states all the way up the road.
-Mr. Shultis states that the pre-existing sheds will be removed once the new shed is built.  Mr. Shultis adds he has no other alternate locations to build the site.  The site primarily consists of a septic system, swamp and pond.  The shed is needed for storage equipment.  The tree line will block the shed from any neighbors.
-There were no questions from the audience.  The board had no further questions.
-W.H. made a motion to close the Public Hearing

New Business

The Great Transition LLC        62.3-4-6       Acres 3.1      Zone s-r

Special Use Permit
Mr. Peter Reynolds was here to represent the file.  Mr. Reynolds  stated they wish to build a Dutch colonial style for professional offices.  The building would be consistent with the residential style of Stone Ridge.  The plan is a copy of an 18th Century house with three small gables facing the street.  The clapboards would be white.  There would be two floors of office space.    In anticipation of DOT regs. I would like  only one curb cut.  I plan on subdividing the site and provide easy access.  The location is determined by the size of proposed lots and meet the required setbacks of the town.  There are a few good trees left and plan on keep existing hardwood vegetation.  I have created enough parking to meet the codes.   
-The maps and file were reviewed by the Board.
-W.H. as do you have a landscaping plan.  PR I plan on keeping existing hardwood trees.
-W.H.asks  is there any screening between the site and neighboring houses.  PR not that I am aware of.
-WH asks RV if he has reviewed arch review with PR
-RV states I am looking into the spec.s regarding arch review.

-WH- the lot itself contains a lot of brush and  overgrowth
-PR- I would like to put in residential type lawn.
-WH- keeping the wooded feel and park it out parking the land

OLD BUSINESS
Mondini 77.2-1-8.300 Area Variance
Comments from Sue:
1. Addition to residence can be achieved by other means
2. Change would create undesired situation to the neighboring properties
3.No screening or substantial distance currently in violation of another area variance request
4.Adverse physical conditions can be discussed in terms of the undesired change in the neighborhood. This request is self -created as a result of a family run business needs to expand family/working space
-Public Hearing was closed last month.
- There is 58 feet between the houses
-If they other neighbor comes and wants to put an addition on that same side how could it be denied?
- Lot is 136 feet wide, if approved it would take up most of the lot.
- Above ground pool could be moved.
- Most of the Board felt that there are other ways to achieve this addition other than granting the variance
